**Terms and Conditions (AGB)**
**1. Scope**
The following Terms and Conditions apply to all orders placed via our online store. Our online store is exclusively aimed at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or professional activity. An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their trade or independent professional activity.
**2. Contracting Party, Conclusion of Contract, Correction Options**
The purchase contract is concluded with Umbrella Motocorp UG (limited liability).
By listing products in our online store, we make a binding offer to conclude a contract for these items. You can initially add our products to the shopping cart without obligation, and you can correct your entries at any time before submitting your binding order by using the correction options provided and explained during the ordering process. The contract is concluded by you accepting the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.
**3. Contract Language, Storage of Contract Text**
The languages available for concluding the contract are German and English.
We store the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
**4. Delivery Terms**
In addition to the product prices quoted, shipping costs may apply. You can find details about any shipping costs in the offers.
You generally have the option to pick up the goods at Umbrella Motocorp UG (limited liability), Einsiedelstraße 8a, 23554 Lübeck, Germany, during the following business hours: anytime by appointment.
We do not deliver to parcel stations.
**5. Payment**
In our shop, the following payment methods are generally available:
- **Prepayment**: If you select prepayment as the payment method, we will provide you with our bank details in a separate email and deliver the goods after receiving payment.
- **Credit Card**: By placing the order, you provide your credit card details. After your authorization as the rightful cardholder, the payment transaction is automatically carried out, and your card is charged.
- **PayPal Express**: During the ordering process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your login credentials, and confirm the payment instruction to us. After placing the order in the shop, we will instruct PayPal to initiate the payment transaction.
- **Google Pay**: To pay the invoice amount via Google Pay, you must be registered with the service provider Google, have Google Pay enabled, authenticate with your credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further instructions are provided during the order process.
- **Apple Pay**: To pay the invoice amount via Apple Pay, you must use the Safari browser, be registered with the service provider Apple, have Apple Pay enabled, authenticate with your credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further instructions are provided during the order process.
- **Amazon Pay**: During the ordering process, you will be redirected to the Amazon website before completing the order process in our online store. To process the order via Amazon and pay the invoice amount, you must be registered there or register first, authenticate with your credentials, and confirm the use of your Amazon data and the payment instruction to us. You will then be redirected back to our online store, where you can complete the order process.
- **Cash on Pickup**: You pay the invoice amount in cash upon pickup.
**6. Retention of Title**
The goods remain our property until full payment has been made.
**7. Shipping Damage**
If goods are delivered with obvious shipping damage, please report such defects to the carrier immediately and contact us as soon as possible. Failure to file a complaint or contact us will not affect your legal rights, especially your warranty rights. However, it helps us assert our claims against the carrier or the transport insurance.
**8. Warranty and Guarantees**
Unless explicitly agreed otherwise below, the statutory warranty rights apply.
For used goods: If the defect occurs after one year from delivery of the goods, warranty claims are excluded. Defects occurring within one year of delivery can be asserted within the statutory limitation period of two years from delivery of the goods.
The above limitations and reductions of the warranty period do not apply to claims for damages caused by us, our legal representatives, or vicarious agents:
• in case of injury to life, body, or health
• in case of willful or grossly negligent breach of duty
• in case of violation of essential contractual obligations that make the proper execution of the contract possible and on which the contracting partner can regularly rely (cardinal obligations)
• within the scope of a guarantee promise, if agreed
• to the extent the product liability law applies.
**9. Liability**
We are liable without limitation for claims arising from damages caused by us, our legal representatives, or vicarious agents:
• in case of injury to life, body, or health
• in case of willful or grossly negligent breach of duty
• in case of guarantee promises, if agreed, or
• to the extent the product liability law applies.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible and on which the contracting partner can regularly rely, by slight negligence of us, our legal representatives, or vicarious agents, liability is limited to the damage foreseeable at the time of the contract conclusion, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
**10. Dispute Resolution**
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
